Influenza mandates in health care institutions are recommended by professional associations as an effective way to prevent the contraction of influenza by patients from health care workers. Health care institutions with such mandates must operate within civil rights frameworks. A recent set of cases against health care institutions with influenza mandates reveals the liabilities posed by federal law that protects employees from religious discrimination. This article examines this legal framework and draws important lessons from this litigation for health care institutions. (...) While vaccination rates in the United States are high — generally over 90 percent — rates of exemptions have been going up, and preventable diseases coming back. Aside from their human cost and the financial cost of treatment imposed on those who become ill, outbreaks impose financial costs on an already burdened public health system, diverting resources from other areas. This article examines the financial costs of non-vaccination, showing how high they can be and what they include. It makes a (...) case for requiring those who do not vaccinate to cover the costs of outbreak caused by their choice. Such recouping is justified because the choice not to vaccinate can easily be seen as negligent. But even if it is not, that choice involves imposing costs on others, and there are good reasons to require the actors to internalize those costs. The article proposes alternative statutory and regulatory schemes to cover the costs imposed on the public purse, focusing on no-fault mechanisms. We consider both ex ante mechanisms like a tax or a fee that will go into a no-fault fund to cover the costs and ex post mechanisms like a statutory authorization for recoupment of those costs by health officials. This article argues that the Supreme Court should not require a religious exemption from vaccine mandates. For children, who cannot yet make autonomous religious decision, religious exemptions would allow parents to make a choice that puts the child at risk and makes the shared environment of the school unsafe — risking other people’s children. For adults, there are still good reasons not to require a religious exemption, since vaccines mandates are adopted for public health reasons, not to target religion, are (...) an area where free riding is a real risk, no religion actually prohibits vaccinating under a mandate, and policing religious exemptions is very difficult. In their thoughtful, nuanced and interesting discussion, Jonathan Pugh, Julian Savulescu, Rebecca Brown and Dom Wilkinson argued that officials should recognise proof of prior infection as a valid exemption from vaccination requirements.1 This commentary agrees with parts of their analysis, but argues that the case for the exemption is less clear than the authors suggest, and the better approach is to allow officials flexibility: an exemption for natural immunity may be appropriate or may not. In part, the disagreements may stem (...) from different experiences in different societies. The authors are in the UK, and their experience may differ from the USA in multiple ways, three very glaring. First, the UK broadly used the AstraZeneca vaccine, which has higher risks than the mRNA vaccines, so our assessment of vaccine risks differs. Second, the UK has universal health insurance, so some of the access to testing issues that I raise concerns about may not apply there. And third, the risk of fraud or misrepresentation may be less in the UK—and other countries—than in the USA, where real concerns about, for example, fake vaccine cards have led to multiple arrests.2 Another issue is that information about COVID-19 changes fast—what was known when the authors wrote may no longer fit the current picture. In their article, the authors argue that it is ethically imperative that COVID-19 mandates exempt those with natural immunity. The authors argue that those who have become immune through infection are ‘potentially equivalent’ to those who were vaccinated, and refusing them an exemption is ethically unjustified—they call this the ‘unnaturalistic fallacy’. Laws and policies are vital tools in preventing outbreaks and limiting the further spread of disease, but they can vary in content and implementation. This manuscript provides insight into challenges in responding to recent vaccine-preventable disease outbreaks by examining legislative changes in California, policy changes on certain university campuses, and the laws implicated in a measles outbreak in Minnesota.

When sharing a task with another person that requires turn taking, as in doubles games of table tennis, performance on the shared task is similar to performing the whole task alone. This has been taken to indicate that humans co-represent their partner’s task share, as if it were their own. Task co-representation allows prediction of the other’s responses when it is the other’s turn, and leads to response conflict in joint interference tasks. However, data from our lab cast doubt on (...) the view that task co-representation and resulting response conflict are the only or even primary source of effects observed in task sharing. Recent findings furthermore suggest another potential source of interference in joint task performance that has been neglected so far: Self-other discrimination and conflict related to agent identification (i.e., determining whether it is “my” or the other’s turn). Based on these findings we propose that participants might not always co-represent what their partner is supposed to do, but instead co-represent that another agent is responsible for part of the task, and when it is his turn. The aim of this paper is to introduce the instrumental variables technique to the discussion about causal inference in econometrics. I show that it may lead to causally incorrect conclusions unless some fairly strong causal background assumptions are made, assumptions which are usually left implicit by econometricians. These assumptions are very similar to, albeit not identical with, James Woodward's definition of an ‘intervention’. I discuss similarities and differences of the two points of view and argue that—understood as a practical method (...) of causal inference—the set presented here is superior. (shrink)

Evidentialism is the view that facts about whether or not an agent is justified in having a particular belief are entirely determined by facts about the agent’s evidence; the agent’s practical needs and interests are irrelevant. I examine an array of arguments against evidentialism (by Jeremy Fantl, Matthew McGrath, David Owens, and others), and demonstrate how their force is affected when we take into account the relation between degrees of belief and outright belief. Once we are sensitive to one of (...) the factors that secure thresholds for outright believing (namely, outright believing that p in a given circumstance requires, at the minimum, that one’s degree of belief that p is high enough for one to be willing to act as if p in the circumstances), we see how pragmatic considerations can be relevant to facts about whether or not an agent is justified in believing that p—but largely as a consequence of the pragmatic constraints on outright believing. We argue that in extensive decision problems (extensive games with a single player) with imperfect recall care must be taken in interpreting information sets and strategies. Alternative interpretations allow for different kinds of analysis. In the human sciences, experimental research is used to establish causal relationships. However, the extrapolation of these results to the target population can be problematic. To facilitate extrapolation, we propose to use the statistical technique Latent Class Regression Analysis in combination with the analogical reasoning theory for extrapolation. This statistical technique can identify latent classes that differ in the effect of X on Y. This paper claims that indefinite descriptions, singular and plural, have different scope properties than genuine quantifiers. This claim is based on their distinct behavior in island constructions: while indefinites in islands can have intermediate (and maximal) scope readings, quantifiers cannot. Further, the simplest in situ interpretation strategy for indefinites results in incorrect truth conditions for intermediate (and maximal) scope readings. I introduce a mechanism which “auto-matically” preserves the restriction on free variables corresponding to indefinites, in a way which allows the (...) restriction to be carried up in the course of semantic interpretation and to be used at the level where the variable is quantified. This mechanism is a realization of the “indefinites-as-free-variables” proposal of Lewis, Kamp, and Heim, but emphasizes the role of the restriction. The appearance of life on Earth represents one of the stages in this process.

Beginning with Margaret Somers and Christopher Roberts’ review of the sociology of human rights and Bryan Turner and Malcolm Waters’ debate therein, the author presents some of the questions which have been so far been the focus of this sociological sub-discipline. This review raises the question of ‘rights’ as a subject of study, and the normative consequences therein. From here, the author introduces recognition theory as a potential participant in these discussions around human rights. The author traces recognition theory from (...) its Hegelian origins to the work of Axel Honneth, and the critiques of Nancy Fraser, Frantz Fanon, and Glen Sean Coulthard. Despite Fanon and Coulthard’s critical accounts, they reinforce the value of recognition within any sociology of human rights. Lastly, the author briefly engages with Alasdair MacIntyre as both a dialogical participant, and a means towards dialogue in the first place between recognition theory and human rights. Pragmatic-Psychoanalytic Interpretations of Amos Oz's Writings: Words Significantly Uttered presents intermediate links between three intellectual domains: the literary works of Amos Oz, American Pragmatism, and object-relations psychoanalysis.

Human intentional action, including the design and use of artifacts, involves the prior mental representation of the goal (end) and the means to achieve that goal. This representation is part of the efficient cause of the action, and thus can be used to explain both the action and the achievement of the end. This is intentional teleological explanation. More generally, teleological explanation that depends on the real existence of a representation of the goal (and the means to achieve it) can (...) be called representational teleological explanation. Such explanations in biology can involve both external representations (e.g., ideas in the mind of God) and internal representations (souls, vital powers, entelechies, developmental programs, etc.). However, another type of explanation of intentional action (or any other process) is possible. Given that an action achieving a result occurs, the action can be explained as fulfilling the necessary conditions (means) for that result (end), and, reciprocally, the result explained by the occurrence of those necessary conditions. This is conditional teleological explanation. For organisms, natural selection is often understood metaphorically as the designer, intentionally constructing them for certain ends. Unfortunately, this metaphor is often taken rather too literally, because it has been difficult to conceive of another way to relate natural selection to the process of evolution. I argue that combining a conditional teleological explanation of organisms and of evolution provides such an alternative. This conditional teleology can be grounded in existence or survival. Given that an organism exists, we can explain its existence by the occurrence of the necessary conditions for that existence. This principle of the 'conditions for existence' was introduced by Georges Cuvier in 1800, and provides a valid, conditional teleological method for explaining organismal structure and behavior. From an evolutionary perspective, the conditions for existence are the range of boundary conditions within which the evolutionary process must occur. Moreover, evolutionary change itself can be subjected to conditional teleological explanation, because natural selection theory is primarily a theory about the relation between the conditions for the existence of organisms and the conditions for the existence of traits in populations. I show that failure to distinguish representational from conditional teleological explanation has confused previous attempts to clarify the relation of teleology to biology. (shrink)

Since its birth in 1600 opera has been interpreted as an attempt to revive Greek tragedies in its marvelous music. Its provocative presentation of action and narration entirely in music has been seen as a manifestation of the enchanted universe of sixteenth-century hermeticism. Viewed as a final homage to the magical incantations of the premodern era, late Renaissance operas have been interpreted as the culmination rather than the dissolution of Renaissance culture. This paper proposes that the relationship between the natural (...) and the supernatural in early opera represents a rational mediation between the real and the unreal rather than an enchanted bond between these realms. The paper situates the birth of opera in the context of the epistemological shift of the new science and suggests that opera played a key role in the transition from the old to the modern notions of meaning and truth. The ArgumentThe paper argues that the distinction between modernism and postmodernism can be applied metaphorically to clarify the changing image of music during the late Middle Ages. The paper discusses the scientific and rational strategies that thirteenth century musical theorists applied to revise earlier musical conceptualization. It highlights the thirteenth-century innovative affiliation of music with Aristotelian physics and argues that in a very subtle and seemingly contradictory way music theorists expressed the nascent awareness, if not tacit acknowledgment, of the mundane (...) nature of music. It argues further that in the fourteenth century the issue of representing musical-rhythmical variability by means of a suitable language shifted to the forefront of musical theory and practice. The unprecedented emphasis on musical signs and their semantic behavior as well as the demand to demystify the discourse about rhythmical concepts — so as to question the necessity of metacategories — all point to an affinity between fourteenth century musical thought and postmodern sensibilities. Philosophical debates about the mental life of non-human animals provide an especially vivid illustration of how radically philosophers‘ intuitions concerning other minds can diverge. Do animals have mental states? Of what sort? Do any of the beasts have minds that overlap with ours? Is there any significant continuity between their minds and ours? Davidson is well known for arguing that, for conceptual reasons, at least when it comes to beliefs and other propositional attitudes, non-human animals differ from us in having (...) none. For example, he has argued that having beliefs requires having the concept of belief, which in turn requires language (Davidson (2001a), (2001b)). He has also argued that possession of any propositional attitude presupposes possession of belief, and that attributing any propositional attitude to a creature requires crediting them with the concepts that figure in the specification of the attitude‘s content (Davidson (2001a), (2001b) (2004)). Davidson‘s arguments are tantalizing, but also puzzling, and far from explicit; and they have been subjected to sharp scrutiny and powerful objections from a number of authors in recent years. When people avow their present feelings, sensations, thoughts, etc., they enjoy what may be called “first‐person privilege.” If I now said: “I have a headache,” or “I'm thinking about Venice,” I would be taken at my word: I would normally not be challenged. According to one prominent approach, this privilege is due to a special epistemic access we have to our own present states of mind. On an alternative, deflationary approach the privilege merely reflects a socio‐linguistic convention governing avowals. We (...) reject both approaches. On our proposed account, a full explanation of the privilege must recognize avowals as expressive performances, which can be taken to reveal directly the subject's present mental condition. We are able to improve on special access accounts and deflationary accounts, as well as familiar expressive accounts, by explaining both the asymmetries and the continuities between avowals and other pronouncements, and by locating a genuine though non‐epistemic source for first‐person privilege. We then separate four theses often associated with expressivism – a positive expressivist thesis, a positive constitutivist thesis, a negative ontological thesis, and a negative semantic thesis – and describe how traditional expressivists have attempted to incorporate them. We argue that expressivism in its traditional form may be fatally flawed, but that expressivists nonetheless have the resources for (...) preserving what is essential to their view. These resources comprise a re‐configuring of expressivism, the result of which is the view we call ‘neo‐expressivism’. After illustrating how the neo‐expressivist model works in the case of avowals and ethical claims, we explain how it avoids the problems of traditional expressivism. (shrink)

This commentary discusses the relation between Grodzinsky's target article and Friederici's (1995) model of syntactic processing. The two models can be made more compatible if it is assumed that people with Broca's aphasia have a problem in trace construction rather than trace deletion, and that the process of trace construction takes place during the second early syntactic substage of Friederici's model.

The purpose of this study is to trace junior high school teachers? perspectives regarding the strengths and weaknesses of their type of school, and to glean more information concerning their preferable type of grade configuration. To this end, 25 teachers filled out an open questionnaire and six of them were further interviewed to provide more insight into the teachers? responses. Reflective journal writing has been recognized as an effective pedagogical tool for nurturing students’ lifelong learning skills. With the paucity of empirical work on the dimensionality of reflective writing, this research sought to qualitatively analyze students’ RJ writing and design a generic reflection scheme for identifying dimensions of reflective thinking. Drawing on the theoretical scheme, another aim was to design and validate a questionnaire to measure students’ perceptions of their reflective writing experiences. The last aim was to quantitatively measure the (...) link between perceived reflective writing and students’ tendency to use RJs in their future careers and personal lives. This exploratory sequential research included the following steps: First, experts’ review and analysis of 1312 RJ entries were attained. This step led to the design of a theoretical scheme of reflective writing and a 31-item questionnaire, used to gather data from 171 students. Partial Least Squares analysis corroborated the structure suggested by the theoretical scheme: two timelines–reflections regarding the current course assignments and those related to the student’s future development. Students’ tendency to use reflective skills in their future professional lives was highly connected to their long-term reflections, including learning experiences linked to academic, professional, personal, and multicultural development. The current study’s suggested validated generic scheme can be adapted and integrated into different curricula, thereby possibly increasing the potential of infusing RJ instructional strategies into higher education curricula, improving the quality of reflection in student journals, and promoting lifelong learning skills. Important policy questions cannot be addressed using “the best available evidence” as defined by the evidence-based policy paradigm; the paradigm can change the meaning of questions so that they can be addressed using the preferred kind of evidence; and important evidence that does not meet the standard defined by the paradigm can get ignored. “Counterfactual” readings of might/could have were previously analyzed using metaphysical modal bases. This paper presents examples and scenarios where the assumptions of such a branching-time semantics are not met, because there are facts at the base world that preclude the complement of the modal becoming true. Additional arguments show that counterfactual readings are context dependent. These data motivate a semantics using a circumstantial (or factual) modal base, which refers to context-dependent facts about a world and time.
